These General Terms and Conditions of Sale govern the contractual relationship between Colybry, a French simplified joint-stock company (société par actions simplifiée, SAS) registered under SIREN number 987 448 933, with its registered office at 229 rue Saint-Honoré, 75001 Paris, France, and any individual or business customer (the “Customer”) ordering one of the services offered: administrative assistance, housing search, job matching.
Colybry offers à la carte assistance: the Customer selects the administrative procedures and/or the housing service they need. The job service is free for candidates.
The applicable prices are those displayed on the website at the time of the order, or communicated in a personalised quote. Colybry undertakes to state the total price before any order is confirmed.
Payment is due immediately upon ordering, by card through the website’s secure payment platform. For the housing service, a deposit of €199 is required to start the search; it is deducted from the balance due when the lease is signed, and fully refunded if Colybry is unable to offer a housing solution.
Colybry uses the means necessary to properly perform the services ordered, without any guarantee of result (obtaining housing, an administrative appointment within a given time, or a job).
For administrative procedures that require an appointment (cita previa) with the competent Spanish authority, Colybry guarantees that this appointment will be obtained. If Colybry is unable to obtain an appointment within a reasonable time given the available slots, the Customer is fully refunded for the procedure concerned. This guarantee covers only obtaining the appointment, not the authority’s decision (actual issue of a document such as the NIE or the Certificado de Registro), which is beyond Colybry’s control.
7.1. In accordance with Articles L221-18 et seq. of the French Consumer Code (Code de la consommation), a consumer Customer has fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without giving any reason and without bearing any costs other than those set out in Article 7.3.
7.2. To exercise this right, the Customer informs Colybry of their decision by an unequivocal statement sent by email to contact@colybry.com or by post to the registered office, where appropriate using the withdrawal form in the appendix. Colybry refunds all sums paid no later than fourteen (14) days after receiving this decision, using the same means of payment as for the order, subject to Article 7.3.
7.3. Immediate start. In the Customer’s interest (faster appointment), procedures may be started before the end of the withdrawal period. This early start only takes place at the Customer’s express request, made when ordering by ticking a dedicated box that is not ticked by default, and confirmed on a durable medium in the order confirmation email. Without this request, performance of the procedures only begins once the withdrawal period has ended.
A Customer who requested an immediate start and then exercises their right of withdrawal pays Colybry an amount proportionate to the services already provided until they communicated their decision to withdraw, in relation to the total price of the procedure concerned (Article L221-25 of the French Consumer Code).
The right of withdrawal can no longer be exercised for a procedure fully performed before the end of the withdrawal period, where performance began with the Customer’s prior express consent and express waiver of their right of withdrawal (Article L221-28, 1° of the French Consumer Code).
This article applies to cancellations made after the end of the withdrawal period set out in Article 7, and to business Customers.
If the Customer cancels a procedure whose performance has not begun, Colybry keeps 30% of the amount paid to cover file and processing costs already incurred; the balance is refunded to the Customer.
No refund is due for a procedure whose performance has begun, subject to the guarantee set out in Article 6.
The housing deposit follows the specific rules set out in Article 4.
Colybry may, as a commercial gesture and on a case-by-case basis, grant a more favourable refund than this article requires.
Colybry cannot be held liable for errors, omissions or decisions of the Spanish or Portuguese authorities, nor for the consequences of incomplete or inaccurate information provided by the Customer.
These General Terms and Conditions of Sale are governed by French law. Where the Customer is a consumer habitually resident in another Member State of the European Union, this choice does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
In the event of a dispute, the Customer first sends a written complaint to Colybry (contact@colybry.com), which undertakes to reply within thirty (30) days in order to seek an amicable solution.
Failing agreement, a consumer Customer may bring proceedings, at their choice, before the courts of their place of domicile or those of Colybry’s registered office; Colybry may only bring proceedings against a consumer Customer before the courts of their place of domicile (Article 18 of Regulation (EU) No 1215/2012). Disputes with a business Customer fall under the exclusive jurisdiction of the courts of Colybry’s registered office.
